Windows 10 New Default Settings May Open HIPAA Backdoors. Or not.

Like 67 million others in the first week of release, I have upgraded to Windows 10. It was a painless transition which held no drama - it just worked. I was, however, interested to discover the defaults which the new Microsoft operating system ships with. Defaults which could potentially compromise the security and stability of medical practices and facilities. This is what you need to know.

Windows 10 introduces automatic updating by default. Updates will occur when Microsoft says they will. This is good, in that any zero day patches for serious issues will be rolled out automatically, protecting the entire Windows using population even while they sleep. That is pretty amazing. It could be problematic, however, if Microsoft decides to reboot all your practice computers during the working day. Imagine a power outage. Same result. You can override this new default and set your own schedule, and I will show you how to do this further on in this article.

According to a market research report from Mordor Intelligence, the future holds great things for all things telehealth. The academically titled report, 'Global Telemedicine Market - Growth, Trends & Forecasts (2015 - 2020)', advises that the primary market areas to exhibit growth will be telepathology, teleradiology, teledermatology and telepsychology.

'Telehealth' is the latest buzz word to hit the medical arena, replacing its predecessor, the now ageing 'telemedicine', due to the incredible diversity and growth in modern technology which goes far beyond just medicine. Telehealth, from the same Greek root 'tele', meaning 'distant', is a compound word which covers all aspects of remote healthcare.

The Forever Family Walk

From California to New York, over mountains and across deserts, through rain and wind and storm, Jarett will be walking, and volunteering at least one day to selected foster care organizations in each state as he travels. Medicare: Study Indicates OOP Costs Exceed Deductibles for Many

Researchers at the Perelman School of Medicine (University of Pennsylvania) discovered that for over 25% of Medicare beneficiaries with multiple observation stays, the out-of-pocket costs exceeds what their inpatient hospital admission deductibles would cost. The growing trend to have Medicare patients admitted for observation is understandable, given that providers do not want to see their Medicare claims denied further down the line. The cost, though, is being deferred to those patients that find themselves in hospital for observation several times before finally achieving Inpatient status and receiving treatment.

Medicare considers Observation care as Outpatient service, regardless of where in the hospital they actually stay - be that a ward, private room, or the ER. Outpatient equals out of pocket. Costs for the visit will usually fall below the regular Medicare plan deductible ceiling.

Expired Patents Will Soon Save Billions

Pharmaceuticals are expensive. Very expensive. Some of that cost is due to patents on drugs and medications, which force drug manufacturers to pay high licensing fees just for the right to be able to use a particular methodology or base material to get their products off the production line and into pharmacies: Patenting molecules is big business.

Researchers at the University of Maryland School of Medicine believe this may be about to change. Their recent study indicates that patents on several commonly used antipsychotics are due to expire shortly, opening the door for manufacturers to create generic alternatives. Alternatives which will come in significantly cheaper, reducing the cost of medications across the board. Treatment facilities, hospitals, community care patients and Medicare itself will be able to access this newly affordable drug market at much more budget-conscious levels as market forces kick in and manufacturers compete on price. That is good. Very good.

Congress Sends Letter to OMB and HHS, Urging Stage 3 Delay

With ICD-10 due to hit the streets on October 1st, the already reeling healthcare industry was rocked again when on September 28, 116 members of Congress wrote a co-signed letter to the Office of Management and Budget (OMB) and the Department of Health and Human Services (HHS) urging a delay of the implementation of Stage 3 rules for Meaningful Use.

The nine page letter comprises one and a half pages of writing - and seven and a half pages of congressional signatures.

Reliance on GEM for ICD-10. Good or bad?

Good or bad, ICD-10 launched on October 1st 2015. Many are scrambling to make sense of the change and adapt to the huge increase in the numbers of diagnostic codes now available. The ICD-9 codes, which many know by heart, are no longer valid - they need an ICD-10 code instead.

To help address this, many vendors have provided General Equivalency Mapping utilities, GEM for short. Sigmund Software includes a GEM as part of our own EHR suite. GEM utilities enable care providers to input a known ICD-9 code, and then select from a broad range of matching new ICD-10 codes.

So, are GEM's also good, or bad? Our clients unanimously agree, definitely good. We worked hard to make ours user-friendly and intuitive. Our GEM helps Sigmund users make sense of the transition between ICD-9 and ICD-10 and speed along the migration process. Terrific!

But of course, it's not that simple.

Sigmund Software ICSA Cert 2014 Compliant-EHR-AmbulatoryOn 29 December 2014, Sigmund Software became officially ONC 2014 Edition Complete Ambulatory certified. As our first anniversary approaches, we reflect that over the past year this certification has helped Sigmund clients successfully comply and attest to Stage 2 Meaningful Use, in turn releasing additional Medicare incentive payments to eligible professionals.

The core objectives met to achieve this certification included extensive testing in the areas of CPOE and eRx, both of which form critical parts of the Safety-Enhanced Design Attestation process, which allows secure interaction between the Sigmund EHR and pharmacies and labs. House Bill Takes Aim At Obamacare

The Patient Protection and Affordable Care Act (PPACA), AKA ACA, or more commonly Obamacare, came under fire again yesterday when the House of Representatives passed another bill to repeal the controversial legislation. Since the ACA was introduced in March of 2010 it has been barraged by efforts to get it off the statute books, having faced over sixty direct challenges during the last five years. This latest challenge looks set to fail as well, as President Obama has promised to veto any bill landing on his desk which aims to derail ACA, the plan intended to overhaul and improve healthcare provision at a national level.

Obama has an Achilles heel, of course. After November he will not be able to veto anything. Whether or not to veto future bills will be a choice which falls on the shoulders of his presidential successor, making this something of a political hot potato and quite an electioneering platform.

Regarding The Question Of Meaningful Use

It is no longer breaking news that during the recent J. P. Morgan conference in San Francisco, the acting administrator of CMS, Andy Slavitt, announced that Meaningful Use (MU) is going to be replaced in 2016 with, quote, 'something better'.

The questions this raises are too many to enumerate, but I think they can be boiled down to three basic ones: When? With what? And "What about my incentive payments?"

In the wake of the J.P. Morgan conference and CMS' pro tem administrator Andy Slavitt's bombshell announcement that "In 2016, MU as it has existed - with MACRA - will now be effectively over and replaced with something better", speculation has been rife. But nothing has reached my ears concerning the specifics. In fact, the CMS web site has been conspicuously silent on the subject.

Such an impactful change should not be like a magician pulling a dollar out of your ear. I for one don't want to experience the surprise of being presented with such sleight of hand. I personally would prefer to know what, where, when and how. The mechanics. Does anyone out there have anything concrete to offer on this subject, beyond guesswork? I find the silence deafening.

January 29 marks the release of a David Bowie tribute issue of Rolling Stone magazine. Following Bowie's death on January 10, a great many artists spoke of the influence this controversial musician had made on their lives, their musical choices and their careers. That in itself is inspirational.

Beyond the musical influence, beyond the stardom and the Fame (I had to get at least one Bowie song reference in somewhere), Bowie himself has a well-documented history of drug abuse and was well along the path to self-destruction as far back as the Ziggy Stardust days of the seventies. There are many stories of wild excesses and behaviour that follow the traditional rock star pattern. But unlike many others that were chewed up and spit out by the intensity of living their lives in the media spotlight, Bowie somehow turned it around and came out the other side, stronger than ever.

Sigmund Client Conference 2016

This item is a brief post-conference analysis of the 2016 event, held recently at the Westin Hotel, Times Square in New York, New York.

The conference had several objectives. We wanted to educate our client base on the latest developments, best practices and work flows in the Sigmund EHR. We also wanted to officially announce the launch of the AURA mobile interface for the Sigmund EHR platform. And we wanted to gather feedback from those that actually use our product every day in a real-world working environment.

Check, check and check. Without tooting our own horn too loudly, we think that we succeeded on every front. And so do our clients.

Security Begins At Home

June 23 2016 saw the conviction by a federal jury of Jamie Knapp, 26, a (former) respiratory therapist at ProMedica Bay Park Hospital, Oregon, Ohio.

Knapp was found guilty of wrongfully accessing patient protected health information (PHI) between May 2013 and March 2014. Knapp was fully authorized to access this information. It was the use to which the PHI was put that was illegal.

Interoperability In The Smaller Facility

At the recent ONC Annual Meeting the ONC Principal Deputy National Coordinator, Dr. Vindell Washington, confirmed that the great majority of non-federal acute care hospitals now operate through certified electronic health record (EHR) systems, and that of this number 82 percent now routinely exchange lab and radiology reports, clinical summaries, medication lists and other data with external medical providers and partners such as ambulatory care facilities and doctors offices.

Dr. Washington notes that since 2008 this percentage has doubled, being only 42 percent 8 short years ago. Dr. Washington went on to note, however, that a recent ONC report highlighted that smaller facilities, rural hospitals and critical access hospitals (CAHs) have been less successful in their transition to an interoperable environment, and have been more resistant to adoption of an EHR solution that can provide the interoperability needed. Statistics show that rural hospitals in particular are achieving only half this engagement rate - in other words, the 2008 implementation rate is unchanged. 42 percent. No progress.

Patient Brokering: Don't do it.

The addiction treatment provider community in Florida has been shaken following the arrest of James Kigar, CEO of Whole Life Recovery, a prominent drug and alcohol treatment facility based in Boyton, Florida. This rabbit hole just keeps getting deeper, and as investigators from the State Attorney's Sober Home Task Force dig ever deeper, the list of charges continue to grow.

At the time of writing, Kigar faces 95 counts of patient brokering. Many affiliated organizations that work with Whole Life Recovery are now being drawn into the investigation, and some are facing charges of their own. And here's the important thing: Whether they knowingly participated in illegal activity, or not.
